Pursuant to Section 104(a) of the Marshall Islands Administrative Procedure Act 1979 (6
MIRC Ch. 1), and Section 120(2) of the Marshall Islands Marine Resources Authority
Act, 1997 (51 MIRC Ch.1), the Marshall Islands Marine Resources Authority wishes to
submit this Notice to the General Public of the proposed DRAFT Protected Areas
Network (PAN) (National Sanctuaries of Bikar and Bokak) Regulations, 2024. Copies of
the Regulations have been posted in the office of the Chief Secretary, in the office of
each department head of the Public Service, at the office of the Chief Secretary’s
Representative on Ebeye, at the Courthouse on Majuro Atoll and at the Council Buildings
on Majuro Atoll and Ebeye Island, Kwajalein.
Section 522 of the Protected Areas Network (PAN) Act, 2015 (35 MIRC Ch.5),
regulations are to be promulgated to give effect to said Act “The Ministry of Resources
and Development may make regulations pursuant to the Administrative Procedures Act,
governing the recognition of the areas nominated by the LRC or local community as
protected areas and the operation of the Protected Areas Network, provided that no rule
or regulation which relates to the permitted use of any area shall be applied to a protected
area unless such rule or regulation shall also have been specifically agreed to by the
appropriate LRC under a protected area management plan or local government officials
pursuant to and in accordance with all applicable laws”.
Any comments should be provided to the Marshall Islands Marine Resources Authority
no later than 20th December, 2024.
